1 Overview

This Universal Terms of Service Agreement (this "Agreement") is entered into by and between FreeHostingStar ("FreeHostingStar," "we," "us," or "our") and you ("User," "you," or "your"), and is made effective as of the date of your use of this website or the date of electronic acceptance.

This Agreement sets forth the general terms and conditions of your use of the site and the products and services accessible through it (collectively, the "Services"). Whether you are simply browsing or using this site, your use and your electronic acceptance of this Agreement signifies that you have read, understood, acknowledged, and agreed to be bound by these terms.

FreeHostingStar may, in its sole and absolute discretion, change or modify this Agreement at any time, and such changes shall be effective immediately upon posting. Your continued use of the site or the Services after any changes constitutes your acceptance of this Agreement as last revised.

2 Eligibility & Authority

This site and the Services are available only to users who can form legally binding contracts under applicable law. By using this site or the Services, you represent and warrant that you are:

1. At least eighteen (18) years of age;
2. Otherwise recognized as being able to form legally binding contracts under applicable law; and
3. Not a person barred from purchasing or receiving the Services under applicable law.

If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms contained in this Agreement.

FreeHostingStar is concerned about the safety and privacy of all its users, particularly children. As the legal guardian, it is your responsibility to determine whether any of the Service areas and/or content are appropriate for your child.

3 Accounts & Data

Account Responsibility

In order to access some features of this site or use some Services, you will need to create an Account. You represent and warrant that all information you submit when creating your Account is accurate, current, and complete, and that you will keep your Account information accurate, current, and complete at all times.

You are solely responsible for all activity that occurs on your Account, whether authorized by you or not. You must keep your Account credentials secure and notify FreeHostingStar immediately of any breach of security or unauthorized use of your Account.

Transfer of Data Abroad

If you are visiting this site from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries. By visiting this site and communicating electronically with us, you consent to such transfers.

4 Availability of Services

Subject to the terms and conditions of this Agreement, we shall use commercially reasonable efforts to provide the Services on a twenty-four (24) hours a day, seven (7) days a week basis. You acknowledge and agree that from time to time this site may be inaccessible or inoperable for reasons including equipment malfunctions, periodic maintenance, or causes beyond our reasonable control.

FreeHostingStar may from time to time offer new Services in a pre-release version ("Trial Services"). Your use of any Trial Services is subject to additional terms, including that they are provided "as-is" and may not work properly, and that FreeHostingStar may modify or discontinue them at any time.

5 General Rules of Conduct

You acknowledge and agree that your use of this site and the Services, including any content you submit, will comply with this Agreement and all applicable laws, rules, and regulations. You will not use this site or the Services in a manner that:

• Is illegal, or promotes or encourages illegal activity;
• Promotes, encourages, or engages in pornography or other adult-only content;
• Promotes, encourages, or engages in harm or exploitation of children;
• Promotes, encourages, or engages in terrorism or violence;
• Promotes, encourages, or engages in spam or unsolicited bulk email;
• Infringes on the intellectual property rights of any person or entity;
• Violates the privacy or publicity rights of another user or any other person or entity;
• Interferes with the operation of this site or the Services;
• Contains or installs executable files, viruses, worms, Trojan horses, or other malicious code;
• Contains false or deceptive language regarding FreeHostingStar or its Services.

You will not copy, distribute, or modify any part of this site or the Services without FreeHostingStar's express prior written consent. You will not impersonate any person or entity, including FreeHostingStar officials or staff.

6 Acceptable Server Resource Use

Sites must not use excessive amounts of server resources, including bandwidth, processor utilization, and disk space. FreeHostingStar may establish general practices and limits concerning use of the Service, and reserves the right to suspend or modify accounts that violate these limits.

Script Usage

Scripts on the site must be designed to produce web-based content. Scripts that provide proxy services, send bulk email, or are designed to use the server as a general-purpose application server are not allowed. The primary purpose of any script must be to produce a web page.

Disk Space Usage

All files on a domain must be part of the active website and linked to the site. Sites should not contain backups, downloads, or other non-web-based content. Archives of movie files, audio files, ZIP/RAR archives, or other files used primarily for downloading or sharing are not allowed.

Account Limits

A maximum of three (3) free hosting accounts are allowed per person. Registering more than three accounts is considered abuse and will result in all accounts being terminated without notice.

7 Content Rights

FreeHostingStar Content

All content on this site owned or licensed to FreeHostingStar, including text, software, scripts, graphics, photos, sounds, videos, and interactive features ("FreeHostingStar Content"), is subject to copyright, trademark, and other intellectual property protections. FreeHostingStar Content is provided to you "as-is" for your personal, non-commercial use only and may not be copied, reproduced, distributed, or otherwise exploited without our express prior written consent.

Your Content

Some features of this site may allow users to post, publish, share, or manage content including ideas, opinions, literary works, photos, and videos ("User Content"). By posting or publishing User Content to this site or through the Services, you represent and warrant that you have all necessary rights to distribute such User Content, and that it does not violate the rights of any third party.

8 Our Use of Your Content

You shall be solely responsible for any and all of your User Content submitted through your Account. If you have a website or other content hosted by FreeHostingStar, you shall retain all of your ownership or licensed rights in that User Content.

By posting or publishing User Content to this site or through the Services, you authorize FreeHostingStar to use the intellectual property and other proprietary rights in and to your User Content to enable inclusion and use of the User Content in the manner contemplated by this site and this Agreement. You hereby grant FreeHostingStar a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, and display your User Content in connection with this site and the Services.

9 Monitoring & Account Termination

FreeHostingStar reserves the right to suspend or terminate any hosting services if a website or hosting service consumes excessive server resources or negatively affects other websites or hosting services on a shared or clustered hosting server. FreeHostingStar reserves the right to suspend service at any time without prior notice if the health or normal performance of a service is degraded.

FreeHostingStar and its designees shall have the right in their sole discretion to pre-screen, refuse, or remove any User Content that is available via the Service. FreeHostingStar may terminate a User's access to this site or the Services for posting any material in violation of this Agreement, at any time and without prior notice.

10 Reservation of Rights

FreeHostingStar expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to any Account or Services for any reason, including but not limited to:

1. To correct mistakes made by FreeHostingStar in offering or delivering any Services;
2. To assist with fraud and abuse detection and prevention efforts;
3. To comply with court orders, applicable laws, rules, and regulations;
4. To comply with requests of law enforcement, including subpoena requests;
5. To defend any legal action or threatened legal action; or
6. To avoid any civil or criminal liability on the part of FreeHostingStar, its officers, directors, employees, and agents.

11 No Spam Policy

We do not tolerate the transmission of spam. We monitor all traffic to and from our web servers for indications of spamming. We define spam as the sending of Unsolicited Commercial Email (UCE), Unsolicited Bulk Email (UBE), or Unsolicited Facsimiles sent to recipients as an advertisement or otherwise, without first obtaining prior confirmed consent.

Commercial advertising and bulk emails may only be sent to recipients who have "opted-in" to receive messages. They must include a legitimate return address, the sender's physical address, and an opt-out method in the footer. If we determine services are being used in association with spam, we will redirect, suspend, or cancel any hosting, domain registration, or email services associated with the account.

12 Trademark & Copyright Claims

FreeHostingStar supports the protection of intellectual property. If you would like to submit a trademark claim for violation of a mark on which you hold a valid, registered trademark or service mark, or a copyright claim for material on which you hold a bona fide copyright, please contact us at the email address provided in the Contact section below.

13 Links to Third-Party Websites

This site and the Services may contain links to third-party websites that are not owned or controlled by FreeHostingStar. FreeHostingStar assumes no responsibility for the content, terms and conditions, privacy policies, or practices of any third-party websites. By using this site or the Services, you expressly release FreeHostingStar from any and all liability arising from your use of any third-party website.

14 Disclaimer of Warranties

YOUR USE OF THIS SITE AND THE SERVICES SHALL BE AT YOUR OWN RISK. THIS SITE AND THE SERVICES ARE PROVIDED "AS-IS", "AS AVAILABLE", AND "WITH ALL FAULTS". FREEHOSTINGSTAR DISCLAIMS ALL WARRANTIES, STATUTORY, EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FREEHOSTINGSTAR MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, OR CONTENT OF THIS SITE OR ANY SERVICES FOUND AT THIS SITE.

15 Limitation of Liability

IN NO EVENT SHALL FREEHOSTINGSTAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ALL THIRD-PARTY SERVICE PROVIDERS BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING FROM YOUR USE OF THIS SITE OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY.

IN ADDITION, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS SITE OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. IN NO EVENT SHALL FREEHOSTINGSTAR'S TOTAL AGGREGATE LIABILITY EXCEED $10,000.00 USD.

16 Indemnity

You agree to protect, defend, indemnify, and hold harmless FreeHostingStar and its officers, directors, employees, agents, and third-party service providers from and against any and all claims, demands, costs, expenses, losses, liabilities, and damages of every kind and nature (including, without limitation, reasonable attorneys' fees) imposed upon or incurred by FreeHostingStar directly or indirectly arising from:

1. Your use of and access to this site or the Services;
2. Your violation of any provision of this Agreement or the policies incorporated herein; and/or
3. Your violation of any third-party right, including without limitation any intellectual property or other proprietary right.

17 Discontinued Services

FreeHostingStar reserves the right to cease offering or providing any of the Services at any time, for any or no reason, and without prior notice. In the event that any Service we offer reaches its End-of-Life (EOL), we will attempt to notify you thirty (30) or more days in advance of the EOL date. It is your responsibility to take all necessary steps to replace the Service before the EOL date.

18 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of The Netherlands. You agree to waive the right to trial by jury in any action or proceeding that takes place relating to or arising out of this Agreement.

If a court of competent jurisdiction holds any provision of this Agreement to be illegal, invalid, or otherwise unenforceable, the remaining provisions of this Agreement shall not be affected thereby and shall be found to be valid and enforceable to the fullest extent permitted by law.
